UPDATE: Potential subpoena list in Bragg v. Linden
By Adam Reuters
UPDATE — Linden Lab Chief Financial Office John Zdanowski and eBay founder Pierre Omidyar, an early Linden Lab backer, have been added to the list of potential witnesses in a supplementary filing.
A new filing from the attorney of Marc Bragg in his lawsuit against Linden Lab has a very interesting list of individuals “likely to have discoverable information that may be used to support Plaintiff’s claims” and who are likely to testify at trial:
– Linden Lab CEO Philip Rosedale, former general counsel Ginsu Yoon, CTO Cory Ondrejka, Vice President for Marketing & Community Development Robin Harper and Chairman Mitch Kapor
– Executives from Linden Lab venture capital backers Catamount Ventures, Benchmark Capital, Globespan Capital Partners and Omidyar Network
– Amazon.com CEO Jeff Bezos, another early backer of the company
– Stanford Law professor Lawrence Lessig, who helped Linden Lab to formulate its intellectual property policies
– Virtual world economy experts Julian Dibbell and Edward Castronova
In the wake of an earlier setback to Linden in the Bragg lawsuit, and with the company already facing an unrelated subpoena seeking the disclosure of an avatar’s real-world identity, it’s shaping up to be a busy few months for the Linden legal team.
The filing also outlines the damages Bragg is seeking, including up to $15,000 in restitution/compensatory damages, attorney’s fees of more than $100,000, and “public harm/consumer restitution” of more than $1 million.
